Keith Posehn joined host Lisa Picarille.

Keith is an entrepreneur who grew up in the middle of the Internet boom. He started with video game design, moved to Web development and then into the online marketing world. Keith rose to director of an ad agency, before striking off on his own in 2008 to create Zorz, a successful performance marketing practice. In 2010 he formed AppZorz, a mobile development & marketing technology.

We began by talking about Keith’s roots and affiliate and the status of three different bills being proposed in California that could have far reaching impact on affiliates and technology companies. Keith then talked about how these law will impact his business if passed; why these bills are misguided; what he industry can do to stop them; his move to get venture capitalists involved in the fight and much more.

This week I was joined by Jim Kukral. My regular co-host, Shawn Collins, is super-busy at SXSW and he is also without Internet access at his new home. Thanks, AT&T! I’m sure Shawn will have lots to say about this issue on next week’s podcast.

PMA Industry Report: Legislative Update

Welcome to the Performance Marketing Association Industry Report, a podcast dedicated to the most pressing issues impacting advertisers, publishers, networks and agencies.

Rebecca Madigan joined host Lisa Picarille.

Rebecca is the executive director of the PMA, which she co-founded in 2008. Rebecca was formerly director of product management at Commission Junction, Impact Radius, and at Lurn, Inc., She has over 25 years of leadership experience in product management and marketing.

We talked about legislative issues and the affiliate nexus tax.

We began by first defining the affiliate nexus tax – what it is and how it works. We then jumped into why laws of this type are flawed; why affiliates do not constitute nexus; that grassroots efforts can work; the importance of affiliates interacting with their legislators; and more.

We then gave an update of states where the affiliate nexus tax has come up again and states that are at high risk including:

California
CA Google Group

Connecticut
CT Google Group

Illinois
IL Google Group

We also talked about other states where things are brewing again including: Rhode Island, Vermont, Virginia, Texas, Mississippi, Minnesota, Tennessee, Arkansas, Georgia, South Carolina, Colorado and Oklahoma.

PMA Industry Report: Looking Ahead to 2011
