Coming to Terms with Terms and Conditions

Welcome to the Performance Marketing Association Industry Report, a podcast dedicated to the most pressing issues impacting advertisers, publishers, networks and agencies.

For this episode we talked about the Terms and Conditions that exist between merchants and publishers.

Lisa Picarille hosted and was joined by Tony Pantano and Durk Price.

Tony is the CEO of Imwave, which focuses on building and launching effective pay-per-click search engine keyword marketing campaigns for their affiliate marketing partners. He has been active in the Affiliate Marketing industry since 2006.

Tony began his career in the Internet industry 16 years ago. He served as President of D&E SuperNet and later as Vice President of Business Services for EarthLink company and as Regional Vice President of Interactive Media & Director of Marketing with the York Newspaper Company.

Durk is the founder and CEO of eAccountableOPM, a firm that specializes in outsourced program management. He’s been actively working on the Internet since 1992 doing web design, programming and content creation. After working for several dot com’s, he started his own agency in 2000 and began focusing solely on outsource program management five years ago.

We began the discussion with a brief explanation of what terms and conditions entail. We then moved on to talking about how much T’s & C’s vary from merchant to merchant; how knowledgeable about affiliate marketing those setting up the terms are; the revision process; violations of terms; how changes to T’s & C’s are communicated to publishers; if that system could be changed for more effective communication; if there needs to be standardization and more.
