Ebates and FatWallet say they’re unconcerned about the loyalty affiliate lawsuit, but I’ve found out that Source, Inc. has gotten settlements out of a couple of other loyalty programs in the past (Upromise was one). I think the fact that they filed suit in Marshall, TX, known for being friendly to patent trolls — see http://www.technologyreview.com/InfoTech-Software/wtr_16280,300,p1.html?PM=GO — is an indication that Source is just out to get fast settlements out of these companies, and not to shut them down permanently.

I know there’s not a lot of love lost in the affiliate world for the loyalty programs like Ebates (though we consumers love ‘em), surely there has to be some sympathy just in general for small business owners like the people behind QuickRewards.net and LittleGrad, who don’t have the deep pockets required to fight off a nuisance suit like this and will probably have to cave in and settle for whatever Source wants.
